For Coroner Leland, this was the last straw. For three days his official function had been subverted by the district attorney’s office. The DA had failed to produce witnesses, had insisted on changing the order in which witnesses appeared, and now was resisting the coroner’s attempts to hear evidence from two crucial witnesses who had been subpoenaed to attend and give evidence. Angrily, the coroner asked Brady why he had not made this statement yesterday, why he had allowed a third day’s hearing that he knew he was going to object to. The DA said he had ‘been busy’. The coroner exploded:

Last evening, I put up to the jury that very question, as to whether they believed that with the evidence at hand, they could bring in a verdict. They felt they would like to hear the evidence of some other people who were present at that party. There are many things, Judge, which enter into the possibility of the cause of death. We have for example the condition of Miss Rappe when this witness on the stand entered the room. There are many other features, which might be straightened out by hearing from other witnesses.
